1. INTRODUCTION

These Terms of Sale ("Terms") govern the purchase of digital products, including ebooks, guides, and downloadable content (collectively, "Products"), from My Helpful Books ("Company", "We", "Us", or "Our"), based in Saraya, Bulgaria. By placing an order for any Product through our website, you ("Customer" or "You") agree to be bound by these Terms.

2. ORDER ELIGIBILITY

By placing an order, You represent and warrant that:

You are at least 18 years of age or the age of majority in your jurisdiction.
The information You provide (including name, email, and payment details) is true, accurate, and complete.
You are buying Products for personal, non-commercial use only.

3. PRICES, PAYMENT, AND MERCHANT OF RECORD

Reseller & Merchant of Record: Our order process is conducted by our online reseller, Digistore24. When you purchase a Product, Digistore24 is the Merchant of Record and your contractual partner for the payment transaction.
Payment Processing: Payments are processed securely through Digistore24. We do not store your full credit card details on our servers. By purchasing, You agree to Digistore24’s terms of sale in addition to ours regarding the use of the product.
Currency: All prices are listed in USD unless stated otherwise.
Taxes (VAT): Prices for Products may be inclusive or exclusive of Value Added Tax (VAT) depending on your location. The final price, including any applicable VAT based on your billing country, will be calculated by Digistore24 and displayed at checkout.

4. PRODUCT DELIVERY

Upon successful payment, Your Product will be delivered in two ways:

Immediate Access: A download link or access button will be provided on the "Thank You" confirmation page (often hosted by Digistore24).
Email Delivery: You will receive an automated email from Digistore24 or us containing your purchase receipt and access credentials.

Please ensure your email address is entered correctly. If You do not receive the email within 10 minutes, please check your spam folder or contact us at support@myhelpfulbooks.com.

5. REFUND POLICY (60-DAY SATISFACTION GUARANTEE)

We are committed to the quality of our resources.

60-Day Guarantee: We offer a 60-Day Money-Back Guarantee. If You are not satisfied with the Product for any reason, You may request a full refund within 60 days of the original purchase date.
How to Request: To initiate a refund, you may contact Digistore24 directly (via the link in your order confirmation email) or email us at support@myhelpfulbooks.com with your Order ID.
Effect of Refund: Upon processing a refund, Your license to use the Product is revoked. You must delete any downloaded copies of the Product immediately.

    Note regarding EU Right of Withdrawal: By purchasing digital content, you acknowledge that the voluntary 60-Day Guarantee offered above is more generous than and replaces the statutory 14-day Right of Withdrawal for digital content. By downloading the product, you acknowledge that performance of the contract has begun and you waive the statutory right of withdrawal.
  

6. INTELLECTUAL PROPERTY & LICENSE

When You purchase a Product, You are granted a limited, non-exclusive, non-transferable, and revocable license to access, download, and view the Product for personal, non-commercial use only.

You may NOT:

Resell, redistribute, or share the Product file with others.
Modify, reproduce, copy, or create derivative works based on the Product.
Upload the Product to file-sharing websites, public forums, or AI training models.

6.1 User Feedback: If You provide us with any ideas, suggestions, scripts, or feedback regarding the Products ("Feedback"), You agree that such Feedback is not confidential and becomes our sole property. We are entitled to use, disclose, reproduce, license, and distribute the Feedback for any purpose without any obligation or compensation to You.

All intellectual property rights remain the sole property of My Helpful Books.

WE DO NOT WARRANT THAT THE PRODUCTS WILL MEET YOUR REQUIREMENTS OR THAT THE INFORMATION IS ACCURATE, COMPLETE, OR CURRENT.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

(A) IN NO EVENT SHALL MY HELPFUL BOOKS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR USE) ARISING OUT OF OR RELATED TO YOUR USE OF THE PRODUCTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.
(B) OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS (SUCH AS CERTAIN US STATES) DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN THESE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

9. GOVERNING LAW AND DISPUTE RESOLUTION

9.1 Governing Law: These Terms concerning the use of our Products and Intellectual Property shall be governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict of law principles. (Note: Disputes regarding the payment transaction specifically may be subject to Digistore24's terms and jurisdiction).

9.2 Exclusive Venue: You agree to submit to the exclusive jurisdiction of the competent courts located in Bulgaria.

9.3 US Customers - Class Action Waiver: IF YOU ARE LOCATED IN THE UNITED STATES, YOU AGREE THAT YOU MAY ONLY RESOLVE DISPUTES WITH US ON AN INDIVIDUAL BASIS, AND MAY NOT BRING A CLAIM AS A PLAINTIFF OR A CLASS MEMBER IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. CLASS ARBITRATIONS, CLASS ACTIONS, PRIVATE ATTORNEY GENERAL ACTIONS, AND CONSOLIDATION WITH OTHER ARBITRATIONS ARE NOT ALLOWED.

10. TECHNOLOGY & SECURITY

While We make every effort to ensure the security of our Products, We cannot guarantee that files available for downloading from the internet or our website will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output.

11. SEVERABILITY

If any provision of these Terms is declared void, illegal, invalid, or unenforceable in whole or in part for any reason, then that provision is to be construed either by modifying it to the minimum extent necessary to make it enforceable (if permitted by law) or disregarding it. The remaining provisions of these Terms shall remain in full force and effect.
